Liability Waiver & Informed Consent ✦ This agreement is made between the undersigned client and Satine Phoenix, in connection with health optimization coaching services. Coaching may include education and guidance on peptides, supplements, nutrition, movement, sleep, stress, and other lifestyle interventions. Please read each clause carefully. Acknowledgment of Non-Medical Status Client understands and acknowledges that Satine Phoenix is not a licensed medical doctor, physician, nurse practitioner, registered nurse, pharmacist, physician assistant, or any other licensed healthcare professional. Coach is not licensed to diagnose illness, prescribe medication, treat disease, or provide any form of medical care. Information shared during health optimization coaching is educational and informational only and is not medical advice. Nothing in this engagement creates a doctor-patient, therapist-patient, or other clinical relationship. Client has been advised to consult a qualified, licensed healthcare provider before starting, stopping, or changing any peptide protocol, supplement, medication, diet, or exercise program, and to seek immediate medical attention for any concerning symptom. Client knowingly and voluntarily waives any obligation on Coach to require such consultation, and accepts full responsibility for any decision to proceed without it. Initial Free and Informed Choice 2. Voluntary Participation Client is engaging in health optimization coaching voluntarily and of Client's own free will. Client is an adult of sound mind, has not been pressured or coerced, and is free to discontinue the coaching relationship at any time. Client is solely responsible for any decision to obtain, possess, or use any peptide, supplement, or related substance, and for complying with all applicable laws and regulations in Client's jurisdiction. Acknowledgment of Risks and Side Effects Client acknowledges that the topics discussed during health optimization coaching — including peptides, supplements, hormones, nutrition, fasting, exercise protocols, and other lifestyle interventions — carry inherent risks. Coach and Client have discussed potential side effects, which may include but are not limited to: injection-site reactions (redness, swelling, bruising, infection); headache, nausea, fatigue, dizziness, flushing, or lightheadedness; changes in appetite, weight, mood, sleep, libido, or energy; gastrointestinal upset; allergic or hypersensitivity reactions, including rare anaphylaxis; hormonal shifts; fluid retention or blood-pressure changes; effects on blood sugar; injuries from exercise or movement; interactions with prescription medications, supplements, or pre-existing conditions; and unknown long-term effects, as many peptides have limited long-term human safety data and are not approved by the U.S. Food and Drug Administration for the purposes commonly discussed in coaching. Client understands that individual response varies, that no specific outcome is promised or guaranteed, and that some risks may not yet be known. Initial Honesty and Accuracy 4. Disclosure of Health Status Client agrees to provide accurate and complete information about Client's health history, medications, supplements, allergies, pregnancy or nursing status, and any other information relevant to safety. Client understands that withholding or misrepresenting information may increase the risk of adverse outcomes, and accepts full responsibility for any consequences arising from incomplete or inaccurate disclosure. Initial Realistic Expectations 5. No Guarantees of Results Coach makes no representation, warranty, or guarantee — expressed or implied — regarding any specific result, benefit, performance improvement, body composition change, hormonal response, or therapeutic outcome. Any examples or testimonials shared are illustrative and are not a promise of similar results. Initial Mutual Protection 6. Release of Liability and Hold Harmless In consideration of the coaching services provided, Client, on behalf of Client and Client's heirs, executors, administrators, successors, and assigns, hereby fully and forever releases, waives, discharges, and holds harmless Satine Phoenix, and her affiliates, agents, and representatives, from any and all claims, demands, actions, causes of action, suits, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees), whether known or unknown, arising out of or related to Client's participation in health optimization coaching or Client's use of any information, protocol, recommendation, or substance discussed, including those caused in whole or in part by ordinary negligence, to the maximum extent permitted by applicable law. This release does not waive liability for gross negligence, willful misconduct, or any liability that, by law, cannot be released. Initial 7. Indemnification Client agrees to indemnify, defend, and hold harmless Satine Phoenix from and against any third-party claims, damages, or expenses (including reasonable attorneys' fees) arising out of Client's acts, omissions, or violations of law in connection with the matters covered by this agreement. Confidentiality Coach will treat Client's personal and health information as confidential and will not disclose it without Client's permission, except as required by law or to protect against imminent harm. Client understands that coaching communications are not protected by medical privilege (e.g., HIPAA does not apply). Initial 9. Severability and Entire Agreement If any provision of this agreement is held unenforceable, the remaining provisions will remain in full force and effect. This document, together with the Client Intake Form, contains the entire understanding between the parties regarding its subject matter and supersedes any prior oral or written agreements.
